Who can order
You must be at least 18 years old and able to enter a binding contract under the Indian Contract Act, 1872. If you’re younger, a parent or guardian must place the order.
Our products
- Every piece is handmade, so shape, shade and finish can vary slightly from the photographs. Colours may also look different depending on your screen.
- Sizes and burn times are approximate and depend on how the candle is used.
- Product photos may include props, trays or flowers for styling. These aren’t included unless the description says so.
- Candles are decorative and fragrance products. Follow the care instructions supplied with them and on our website.
Prices and payment
- All prices are in Indian Rupees (₹) and include all applicable taxes.
- Delivery is charged at a flat ₹150 per order within Maharashtra and ₹250 for the rest of India, shown at checkout before you pay. See Shipping & Delivery.
- We accept the payment methods shown at checkout. Payments are processed by RBI-authorised payment providers. We don’t store your card, UPI or bank details.
- If a product is listed at an obviously wrong price because of an error, we’ll contact you before processing the order. You can then accept the correct price or cancel for a full refund.
Orders
Placing an order is an offer to buy. The contract is formed when we confirm your order by email or WhatsApp. We may decline or cancel an order, with a full refund, if a product is unavailable, payment fails, we can’t deliver to your address, or we have reason to suspect fraud.
Custom and bulk orders
- For custom colours, text or designs, you’re responsible for checking the details you give us. We make the piece as you describe it.
- We may decline designs that are offensive or use someone else’s trademark, logo or artwork without permission.
- Bulk and corporate orders follow the quantities, prices, timelines and payment terms in your written quote.
Delivery, returns and refunds
Delivery is covered by our Shipping & Delivery policy. Cancellations, damaged items, exchanges and refunds are covered by our Returns, Refunds & Cancellation policy. Nothing in these terms limits your rights under the Consumer Protection Act, 2019.
Candle safety
Never leave a burning candle unattended. Keep it away from children, pets, drafts and anything flammable, and place it on a heat-resistant surface. We’re not responsible for loss or injury caused by using a product in a way that ignores these instructions or the care guidance supplied.
Intellectual property
The Benka name and logo, product designs, photographs and text on this website belong to Benka. Please don’t copy, reproduce or use them commercially without our written permission.
Using the website
Don’t misuse the website, for example by trying to gain unauthorised access, uploading harmful code, placing fake orders or posting unlawful content. We may suspend accounts that do.
Limitation of liability
As far as the law allows, our total liability for any claim relating to an order is limited to the amount you paid for that order. We aren’t liable for indirect or consequential losses. This doesn’t exclude any liability that can’t be excluded under Indian law.
Events beyond our control
We’re not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, strikes, courier disruptions or government restrictions. If this affects your order, we’ll let you know and offer a new date or a full refund.
Governing law and disputes
These terms are governed by the laws of India. Please contact us first so we can try to resolve any issue (see Grievance Redressal). Subject to your rights as a consumer to approach the consumer commission with jurisdiction, the courts at our registered place of business have jurisdiction.
Changes
We may update these terms from time to time. The version on the website when you place an order applies to that order.
